Stealing of pictures is called "Picture Piracy". To avoid it, you have to ask permission, or use tagged images. If there's not tag, you can easily steal a picture coughcoughwww.thebestdamngallery.comcoughcough

I've been working on an Avril fansite and there were a bunch of pictures that I need and couldn't find anywhere else. I emailed avril-l and got their permission to use their pictures (with their tags left on).

I think it isn't considered stealing if you use another sites' pictures and leave the tag on.

The untagged photos, not sure. There's always the risk of copyright infringement.
